Garuda CEO under KPPU investigation for holding concurrent positions

JAKARTA - PT Garuda Indonesia (Persero) Tbk (GIAA) CEO Ari Askhara is under investigation by the Business Competition Supervisory Commission (KPPU) for allegedly holding concurrent positions. Mr Askhara was summoned by KPPU on Monday (1/7), accompanied by his legal team along with GIAA Corporate Secretary Ikhsan Rosan and other company officials.

“Yes, we have summoned [Mr Askhara] who is under investigation for allegedly holding concurrent positions, which is a violation of Article 26 of Law No. 5/1999,” said KPPU Commissioner Dinni Melanie as quoted by Kontan.co.id.

Mr Askhara, who was appointed as Garuda CEO in September 2018, currently also serves as President Commissioner of Citilink Indonesia and Sriwijaya Air, with both airlines being members of the Garuda Indonesia Group.

According to Article 26 of Law No. 5/1999 concerning Business Competition, a director or commissioner in a company is forbidden from serving as a director or commissioner in other companies concurrently if the companies involved engage in the same related market, have close relations in a business field, and could simultaneously control the market share which could result in a monopoly and/or unfair competition.
