APOL submits PK to MA on CIMB Niaga's appeal cancellation

JAKARTA - PT Arpeni Pratama Ocean Line Tbk (APOL), a shipping service company, submitted a reconsideration memory (PK) for the appeal cancellation of a peace agreement submitted by PT CIMB Niaga to the Supreme Court (MA).

Quoted from the disclosure of company information, APOL proposed changes to the initial agreement to creditors for the postponement of debt payment obligations (PKPU), which were approved and signed by the majority creditor. However, on March 18, 2019, CIMB Niaga filed a lawsuit through the Commercial Court regarding a request to cancel the peace of the peace agreement signed on November 1, 2011, which had been homologated by Central Jakarta District Court. In this case, the Central Jakarta District Court rejected the request for cancellation of peace submitted by CIMB Niaga on May 27, 2019.

However, CIMB Niaga filed an appeal on 10 June 2019 against the decision of the Central Jakarta District Court. To respond to the cassation proposed by CIMB Niaga, APOL submitted a contra appeal cassation to the Supreme Court on June 20, 2019. The Supreme Court itself passed the case ruling No.04 / Pdt.Sus. Cancellation of Peace / 2019 / PN.Niaga.Jkt.Pst jo MA Cassation Decision No.718 K / Pdt.Sus-Pailit / 2019 CIMB Niaga as a petition applicant stating the cancellation of the peace agreement mechanism.

APOL assesses that the Supreme Court decision that received a CIMB Niaga appeal did not support a series of actions to settle the company's obligations towards the February 7, 2019 peace agreement agreed upon by the majority creditors. (LK)
