KPPU detects a joint effort to determine fuel oil prices by business actors

JAKARTA - The Commission for Supervision and Business Competition (KPPU) detected a joint effort to determine the price of fuel oil (BBM) done by business actors engaged in BBM business. This is believed to be one of the reasons that the price of non-subsidized BBM has not been lowered yet, even though world oil prices have fallen since the beginning of this year.

KPPU member Guntur Saragih said that the KPPU began to investigate allegations regarding this matter. "At present, KPPU has obtained evidence that forms the basis of law enforcement. The regulation violated is article 5 concerning prohibition for business actors to set prices together," he said as quoted from a press release on Friday (15/5).

According to him, the basic formula for the retail selling price of fuel oil made by the government should be able to encourage competition in the sale of non-subsidized fuel. The rules referred to are listed in the Minister of Energy and Mineral Resources Decree No.62 / 2020 concerning Basic Price Formula in Calculating the Retail Sales Price of Gasoline and Solar Diesel Distributed via Public Gas Stations and Fishermen Gas Stations.

He said the price set by business operators could be related to the size of the sales margin, because each company has its own storage and distribution costs, as well as their own sales margin preferences. (LK/AR)
