SOEs Ministry was requested to revoke the dual position policy

JAKARTA - The Ministry of State-owned Enterprises (SOEs) was asked to revoke the dual position policy for SOE’s board of directors and commissioners. This was conveyed by Ukay Karyadi, Member of the Business Competition Supervisory Commission (KPPU), in a press release quoted on Tuesday (23/3).

He explained that multiple positions have the potential to violate healthy business competition, for example, make some companies to be involved easier in market regulation related to prices, practice exclusivity, tying and bundling, as well as control of markets whose business activities are interrelated. "To prevent this potential, KPPU has coordinated with the Ministry of SOEs to revoke the dual position provisions," stated Karyadi.

For information, the Ministry of SOEs issued Regulation No.10/MBU/10/2020 concerning amendments to the Regulation No.2/MBU/02/2015 concerning Requirements and Procedures for the Appointment and Dismissal of Members of the SOE’s Board of Commissioners and Supervisory Board.

Karyadi said that the KPPU was conducting research on the findings of dual positions of SOE directors and commissioners with non-SOE companies in various sectors. "In the mining sector, we found one personnel with dual positions in 22 companies," he said. (LK/VA)
