CARS’s shareholder faces a bankruptcy claim

JAKARTA – PT Ahabe Niaga Selaras (ANS), the owner of 4.69% of PT Industri dan Perdagangan Bintarco Dharma Tbk (CARS), faces a bankruptcy claim or the suspension of debt payment obligation (lit. Kewajiban Penundaaan Pembayaran Utang/PKPU) filed by its creditors, Anggraeni Chandra and Erwin Setia Budi Djaja.

“The company is currently calculating the impact of the said lawsuit on the controlling shareholder position, which is still taken by ANS at this moment,” Lina M. Ibrahim, Corporate Secretary of Industri dan Perdagangan Bintarco Dharma, clarified in the information disclosure quoted Thursday (24/3).

The plaintiff’s attorney, Melisa, SH, and partners, had filed a PKPU lawsuit against ANS under case No.4/Pdt.Sus/PKPU/2022/PN Semarang on March 1, 2022.

ANS is known to have repeatedly dealt with bankruptcy lawsuits submitted by different litigants. For instance, since August 2021, this controlling shareholder of CARS have received four complaints in Semarang District Courts, three of which are PKPU lawsuits that have entered the completion of the case dossier, whereas another one have progressed to the court.

Indeed, ANS reportedly owes IDR 8.21 billion to its two creditors mentioned above, Anggraeni Chandra and Erwin Setia Budi Djaja.

As of February 2022, CARS’s shares amounted to 15 billion units, 9.33% of which belonged to BNYM S/A Weiser, followed by PT Trimegah Sekuritas Tbk (TRIM) of 17.85%, PT Merapi Agung of 11.97%, ANS of 4.69%, and the public of 55.99%. (LK/ZH)
