JAKARTA – The law enforcement over monopolistic practices and unhealthy business competition will be reinstated starting May 1, 2022, after almost two years of relaxation. KPPU issued the relaxation of law enforcement in order to help restore the economy amidst the COVID-19 pandemic.
In a press release quoted Thursday (7/4), Ukay Karyadi, Head of Indonesia Competition Commission (lit. Komisi Pengawas Persaingan Usaha/KPPU), mentioned that the relaxation of the monopolistic practices and unhealthy business competition was terminated after seeing how businesses have adapted to the pandemic struggles.
“With the new normal implementation amidst the COVID-19 pandemic, the monopolistic practices relaxation policy within the business scene is deemed unnecessary,” Karyadi said.
The legal basis of this decision is KPPU Regulation No.2/2020 regarding the Repeal of KPPU Regulation No.3/2020 regarding the Relaxation of Law Enfocement over Monopolistic Practices and Unhealthy Business Competition. As previously stated, the relaxation policy was designed by KPPU in response to the business players who were affected by the COVID-19 pandemic. The relaxation policy encompasses the extension of the shares acquisition notification period from 30 to 60 days, the utilisation of dominance in agreements aimed to control the pandemic spread, and the relaxation of law enforcement activities over goods and services supply provided by the State Budget or the Regional Government Budget.
“KPPU will tighten the monitoring over goods and services supply as well as the 30-days shares acquisition notification deadline and the 14-days period for the responses towards writtern warnings. (LK/ZH)
