Aero Citra Kargo is proven to be monopolising lobster seeds export

JAKARTA – PT Aero Citra Kargo (ACK) is proven guilty of conducting a monopolistic business practice in the lobster seed or unpigmented lobster export sector, referring to Article 17 Laws No.5/1999. This decision was concluded in the Assembly Court of Indonesian Competition Commission (lit. Komisi Pengawas Persaingan Usaha/KPPU) last week (9/6).

Deswin Nur, Head of Public Relation and Cooperation Bureau of KPPU, confirmed that the court found the evidence that ACK is the only company present in the meeting regarding the socialisation of the lobster seed export transportation management.

ACK is the sole exporter of lobster seed/unpigmented lobster since the issuance of the Regulation of Ministry of Maritime Affairs and Fisheries No.12/2020 until November 25, 2020. “The company took over 50% of lobster seed export service, leaving no choice for other exporters beside using ACK’s shipping services,” Nur disclosed.

KPPU believed that ACK is deserving of a IDR 7.65 billion fine or 10% of its market sales. However, it turns out that said company cannot afford to pay its obligations due to zero sales and net profit. The expert of the Directorate-General of Taxes confirmed that the revenue and net profit in ACK’s Financial Statement are down to IDR 0.

Nur further urged President to instruct the ministries and financial institutions to pay attention to Law No.5/1999 concerning the Prohibition of Monopolistic Practices and Unhealthy Business Competition in designing regulations and policies. Furthermore, the Investment Coordinating Board (lit. Badan Koordinasi Penanaman Modal/BKPM) then nullifies the Business Registration Number (lit. Nomor Induk Berusaha/NIB) No.9120302232765 of 2019 involving the transportation management service segment in particular. (LK/ZH)
