Court denies MBSS’s PKPU claim against FIRE

JAKARTA – The Commercial Court of Central Jakarta once again denies the Suspension of Debt Payment Obligation (lit. Penundaan Kewajiban Pembayaran Utang/PKPU) claim filed by PT Mitrabahtera Segara Sejati Tbk (MBSS) against PT Alfa Energi Investama Tbk (FIRE).

Lyna, Corporate Secretary of FIRE, claimed that the company has reviewed the legal proceedings in response to MBSS that have filed a PKPU lawsuit against the company repeatedly. “This objectionable act of MBSS clearly damages the reputation of our company and its shareholders,” she stated in the information disclosure quoted Thursday (22/12).

According to Lyna, this claim affects FIRE’s operational activities. Several vendors and banks have questioned the company regarding said claim and become hesitant in forming business relationship with FIRE. “It is considered a defamation and harm the company as a publicly listed entity,” she added.

FIRE has reportedly won the lawsuit with how the PKPU lawsuit was dropped. The panel of judges said that they have not discovered the fact that the debt is due and collectible by MBSS.

According to Lyna, said decision once again reinforces the previous decision made regarding a similar PKPU petition filed by MBSS on November 3, 2022.  The more recent decision was made for the case registered under No.331/Pdt.Sus-PKPU/2022/PN Niaga.Jkt.Pst, yesterday (21/12). (LK/ZH)
