KPPU: TLKM did not put Netflix at a disadvantage

JAKARTA – PT Telekomunikasi Indonesia (Persero) Tbk (TLKM) and its subsidiary, PT Telekomunikasi Seluler (Telkomsel), are proven not guilty of disserving Netflix regarding internet access restriction. It was the final decision from the panel of the commissions in the court regarding discrimination accusation of the two companies against Netflix, the US-based movies platform service.

Deswin Nur, the Head of Public Relation and Cooperation Bureau of Indonesia Competition Commission (KPPU), explained that the court panels has concluded that both companies were not proven guilty of conducting monopolistic practices against Netflix in internet services provision. “The blockage on fixed broadband and mobile broadband did not result in an unhealthy business competition,” Nur addressed in a press conference, quoted Friday (30/4).

As specified before, KPPU investigated the public complaints regarding TLKM and Telkomsel that restricted access to Netflix in 2016-2018. The complaint proceeded to the court with the presumption of discriminatory practices of those two against Netflix.

It was mentioned that the commission panel found evidence that the internet access blockage exerted by TLKM and Telkomsel was to prevent a potential violation of UU No.44/2008 concerning pornography and UU No.19/2016 regarding electronic information and transaction (ITE). “Netflix suffered no loss, and the consumers still have the option to access Netflix via other internet service providers,” Nur concluded.
