MBSS to file another PKPU lawsuit against FIRE

JAKARTA – PT Mitrabahtera Segara Sejati Tbk (MBSS) yet again files a Suspension of Debt Payment Obligation (lit. Penundaan Kewajiban Pembayaran Utang/PKPU) lawsuit against PT Alfa Energi Investama Tbk (FIRE) in the Commercial Court of Central Jakarta Court District last week (16/11). The same exact lawsuit was once submitted to the same court on November 3, 2022, but it was denied.

Aris Munandar, President Director of FIRE, confirmed that the company had received a subpoena dated November 17, 2022, from the Central Jakarta District Court yesterday (21/11). “Said PKPU lawsuit will impose material impacts on our operational activities,” he stated in the official disclosure quoted today (22/11).

For instance, some suppliers, vendors, and banks will consider this PKPU lawsuit and question their business relations with FIRE.

According to Munandar, the petition filed by MBSS under case No.331/Pdt.Sus-PKPU/2022/PN Niaga Jkt.Pst is similar to the previous one, which was registered under case No.239/Pdt.Sus.PKPU/2022/PN Niaga Jkt. Pst. "MBSS requests for the same material again. Our company will follow the applicable legal proceedings and provisions regarding this PKPU lawsuit,” he added.

The Central Jakarta District Court is known to have denied the previous lawsuit filed by MBSS. At the court, FIRE managed to prove that it did not owe any debts of USD 1.08 million and USD 14.16 million to MBSS, based on MBSS’s own financial reports as of December 2021 and June 2022. (LK/ZH)
